Dear Odesk - Stop Harassing Me!

I have used Odesk several times over a year ago.  I paid for every provider I worked with on time.

 My credit card info was on file for direct withdrawal from my account. I was employing contractors per project and also on an ongoing basis a few contractors.

 There was not one complain from the people that I worked with.

 The last project I awarded here was an Actionscript project, I was looking for a go-to-guy that knows AS well, someone we could go to with our Actionscript projects on an ongoing basis. When I picked a candidate, I gave him his first task and I said our budget for that would be $500, so he should work accordingly on the task.

The provider was not able to do the job as it was required, he was unprofessional and did not know what he was doing, communication was terrible.

After I started the project, which I was budgeting about $500, he ran up the hours to where my charges were around the $550+ area.

The project was not on pace or in the right direction for that matter even though we were already over budget, however my concerns and feedback about this was not received professionally as I said earlier many times my feedback was ignored, candidate did not understand what the requirements were for the project
at least was not demonstrating that he did based on the work he performed.

I called Odesk about this matter and I told them that this amount is about to be withdrawn from my account into this providers account and that I felt that I was being cheated out of my money, so I asked them to stop the payment.

...and this is without me being able to leave feedback for him because of the outstanding payment issue.

The response from Odesk was that I should just let the payment go and they will check into the situation. After this I have not heard back from Odesk and before the payment was about to be taken from my account, I blocked the payment.

Since then, I received a few emails from Odesk demanding payment, they have not made an effort to mediate this situation properly or to mediate it at all as for that matter. Then they sent the amount they think I owe to collection and now they are threatning me that they will take me to court for this as well.

 

I am very disappointed that Odesk ignored my request for help in this matter and did not take into consideration my previous feedback from other providers which clearly shows that I am very fair and honest in dealing on freelance websites and that I was right in denying payment
for this project.

If Odesk does not stop harassing me I will explore what my legal options would be in this matter and will do a press release as well about my experience with this website.

I'm really sorry, you faced this kind of situation. I understand this is a very sensitive issue for you and I'm deeply sorry, if my comments offend you.

You already knew the feedback that the aforementioned provider received earlier (and his provider company doesn't seem to have a great feedback either, at least when compared to the feedback you received so far from other providers). If you have a close look at the provider's profile, you could see that his tests scores are in top 20% or in top 10%. But, the time he took to finish the tests are less than 8 minutes in 4 of the 6 tests. It'd *usually* take at least 10 minutes just to go through all the questions. Don't you think that the provider (or his provider company) *may* have done something to pass the tests with high scores?

Additionally, as you have already hired providers in oDesk and have been here in oDesk for nearly 2 years, you may already know how oDesk functions (hourly vs fixed price model and their guarantees). I think oDesk's policies changed a lot since you last hired a provider here.

For the present situation (you hired a provider on a hourly basis), I believe you have to pay the amount as per oDesk's TOS and then you may dispute.

Your case is interesting to me because I have long term interests related to software. I'm interested to discuss because can help me to refine my skills. I'll try to help you understand better your case.

It seems that oDesk policy is clear in your case: there is work done/logged and is fair to be paid.

Using people without payment is slavery. Do you really wish slaves?

Please note that you are free to divide any task into small steps and to check results after each step. For example in your case you can divide the work into days and review after each day. Also you can hire provider for small initial test task. And if you are not happy with the results you can stop working with the provider. Other possible division is according to functionality...

In other words you are free to make detailed planning and to check whether the provider follows the plan.

It seems that you hadn't make plan and you even expect the coder that you have hired to do it for free.

If you need help with planning there are well known ways: you can hire project manager, software designer, solution architect, technical lead, etc

Also there are many people that heavily underestimate the cost for good development. I have seen flash games that cost amounts like $50000. Are you sure that your task can be done for $500? By the way in your area (Tampa,FL) there is company with freelancers web site that thinks that typical software cost is several hundreds. They ignore the fact that many well known software products cost many millions.

Do you see what I mean? Do you agree? Am I right?
